Major League Baseball’s increasingly complex relationship with legalized sports gambling has reached a critical inflection point, with Philadelphia Phillies superstar Bryce Harper finding himself at the center of a growing controversy. A bipartisan group of lawmakers, including Sen. Richard Blumenthal, Rep. Paul Tonko, and Rep. Valerie Foushee, has formally called on MLB and the Major League Baseball Players Association (MLBPA) to implement stricter prohibitions regarding player participation in sportsbook promotional programs.
The legislative push follows reports that a personalized video message recorded by Harper was allegedly utilized by FanDuel as promotional material for its VIP gambling clientele. According to Harper, the video originated from a November 2024 Cameo request intended as a private holiday greeting for a fan. The All-Star outfielder maintains that he had no knowledge of FanDuel’s involvement, nor did he authorize the company to leverage his likeness for gambling-related marketing.
Congressional Scrutiny of Sportsbook Marketing
The situation has drawn significant attention due to the ongoing litigation involving the fan who received the video, Terry Thompson. Reports indicate that Thompson, who allegedly lost nearly $2 million, was sent the Harper video by his FanDuel VIP host as part of a retention strategy. This incident has prompted lawmakers to demand immediate policy changes from MLB Commissioner Rob Manfred, MLBPA executive director Bruce Meyer, and FanDuel CEO Christian Genetski.
“Despite clear harms that VIP programs pose to bettors, MLB and MLBPA continue to disregard fan safety by permitting partnerships with sportsbooks operating these programs,” the lawmakers wrote. “We demand an immediate end to this policy.”
The congressional inquiry seeks to clarify whether active players should maintain any promotional ties to sportsbooks and demands a review of how player names, images, and likenesses are protected from exploitation by gambling operators. The group has requested formal responses from all involved parties by August 24.
The Integrity of the Game
This controversy exposes the inherent tension within baseball as it navigates the integration of sports betting into its ecosystem. While MLB maintains strict rules prohibiting players from betting on the sport, the league simultaneously benefits from lucrative partnerships with gambling companies.
